Privacy Policy

I. DEFINITIONS
For the purposes of this Privacy Policy, the following definitions apply, in accordance with the General Personal Data Protection Law (LGPD - Law No. 13,709/2018):
User: a natural person who uses the Genuz Software.
Personal Data: any information related to an identified or identifiable natural person.
Sensitive Personal Data: personal data on racial or ethnic origin, religious belief, political opinion, union membership or membership in a religious, philosophical, or political organization, data concerning health or sex life, genetic or biometric data, when linked to a natural person.
Controller: the Licensee, who determines the purposes and means of processing personal data. It is the natural or legal person, under public or private law, who is responsible for decisions regarding the processing of personal data.
Processor: Programmers, which processes personal data on behalf of the Controller. It is a natural or legal person, under public or private law, that processes personal data on behalf of the controller.
Anonymization: use of reasonable and available technical means at the time of processing, through which data loses the possibility of association, direct or indirect, with an individual.
Purpose: the specific purpose for which personal data is collected and processed.
II. DATA WE COLLECT
We collect the following types of data:
Account Information: username, corporate email address, and, if provided, profile photo. This information is provided by the Controller through integrations with authentication providers.
Usage Data: access logs, IP address, browser type, pages visited, features used, and date and time of activities. This data is collected automatically when the User interacts with the Software.
Device Data: device type, operating system, unique identifiers, and language settings. This information is collected to optimize the User's experience in the Software.
Log Information: IP address, browser type, internet service provider, referring/exit pages, operating system, date/time, and click data. This information is automatically recorded by our servers and is not linked to other information we collect about the User.
III. USE OF COOKIES
Cookies are small text files stored on the User's device to improve the browsing experience. Cookies can be used to remember user preferences, such as language and settings, and to provide analysis of Software usage. The User can manage or disable cookies in the browser settings, but this may affect the functionality of Genuz.
IV. HOW WE USE THE DATA
We use the collected data for the following purposes:
Providing and Improving the Software: operating the Software, providing the Services, personalizing the User experience, and improving functionality, performance, and security.
Communication: sending important communications, such as Software updates, information about new features, and responses to support requests.
Analysis and Research: analyzing usage trends, better understanding User needs, and conducting research to improve the Software.
Security and Fraud Prevention: protecting the Software against unauthorized access, misuse, and fraudulent activities.
V. DATA SHARING
We share data with the following entities:
With the Controller: aggregated and anonymized usage data for reporting and analysis purposes, based on fulfillment of contractual obligation.
With service providers: data with third-party service providers that assist us in providing the Services, such as hosting providers and data analysis, subject to contractual obligations of security and confidentiality.
For Legal Purposes: data if we believe in good faith that such disclosure is necessary to comply with laws, regulations, legal processes, or governmental requests; enforce our Terms and Conditions of Use; detect, prevent, or address security or fraud issues; respond to support requests; or protect the rights, property, or safety of the Licensor, Users, and Licensee.
Marketing: only with the explicit consent of the User, we may send marketing communications about our products and services. The User may cancel the receipt of these communications at any time.
At no time will User information be commercialized or passed on to third parties for advertising purposes or other unauthorized uses.
VI. DATA SECURITY
We employ security measures to protect User data, including:
Encryption of data in transit and at rest.
Strict access control, with permissions limited to authorized users.
Regular backups to ensure the integrity of information.
Constant monitoring of systems to detect and prevent vulnerabilities.
Regular team training in information security practices.
VII. DATA RETENTION
We will retain User Data for as long as necessary to fulfill the purposes described in this Policy, or as required by law or by the License Agreement. After this period, the data will be securely deleted or anonymized. Data retention criteria are based on the purpose of collection, legal requirements, and best information security practices.
VIII. USER RIGHTS (DATA SUBJECTS)
The User has the following rights regarding their data, as provided for in the LGPD:
Confirmation and access: right to obtain confirmation that their data is being processed and, if so, to access the data and information about the processing.
Correction: right to correct incomplete, inaccurate, or outdated data.
Anonymization, blocking, or deletion: right to anonymize, block, or delete unnecessary, excessive data or data processed in non-compliance with the LGPD.
Portability: right to receive their data in a structured and interoperable format, and to transmit it to another data controller.
Information about sharing: right to obtain information about the public and private entities with which their data is shared.
Revocation of consent: right to revoke consent for data processing, when processing is based on consent. Revocation will not affect the legality of processing carried out before the revocation.
Opposition: right to oppose data processing carried out on the basis of legitimate interest, if the processing does not meet their interests or fundamental rights and freedoms.
Review of automated decisions: right to request a review of decisions made solely on the basis of automated processing of personal data that affect their interests.
To exercise these rights, the User must contact the Controller.
IX. INTERNATIONAL DATA TRANSFER
We do not perform international transfers of personal data. Information about platform usage and performance that may eventually be shared with companies in the Programmers group, exclusively for the purpose of improving our services. In this case, the data is aggregated and anonymized, not allowing the identification of individual users. This sharing does not characterize an international transfer of personal data, as defined in the LGPD.
X. CHANGES TO THIS POLICY
We may update this Policy periodically. Changes will be published on this page and, if the changes are significant, we will notify the User by email or through a prominent notice in the Software.
